These General Terms of Use (hereinafter the "GTU") govern access to and use of the fragrancepassion.fr website (hereinafter the "Site") operated by Fragrance Passion. They are separate from the General Terms and Conditions of Sale, which govern purchases made on the Site. By accessing and using the Site, you agree to these GTU.

Article 1 - Access to the Site and legal capacity

By using the Site, you declare that you have reached the age of legal majority in your country of residence and have full legal capacity to enter into a contract. If you are a minor, you may use the Site only under the supervision of and with the consent of your legal representative, who remains responsible for such use.

The use of our products or the Site for any unlawful or unauthorised purpose is prohibited. When using the Site, you agree to comply with all applicable laws and regulations, in particular French law, including but not limited to laws relating to copyright.

You agree not to transmit any worms, viruses, or any other destructive code, nor to compromise the security or proper functioning of the Site.

Any breach or violation of these GTU may result in the immediate suspension or termination of your access to the Services, without prejudice to any legal action that may be taken.

Article 2 - Availability of the Site

We strive to ensure that the Site is accessible 24 hours a day, 7 days a week, but cannot guarantee this. Access to the Site may be suspended, in particular for maintenance or updates, or in the event of force majeure, without our liability being incurred. We reserve the right to modify, suspend, or discontinue all or part of the Site at any time.

Article 3 - Customer account

Creating an account may be necessary to access certain services. You are responsible for the accuracy of the information provided and for the confidentiality of your login credentials. Any action carried out from your account shall be deemed to have been carried out by you. In the event of unauthorised use of your account, you agree to inform us without delay. We reserve the right to suspend or delete any account in the event of a breach of these GTU.

Article 4 - Intellectual property

All elements of the Site (texts, visuals, photographs, logos, trademarks, illustrations, layout, structure, database) are protected by intellectual property law and remain the exclusive property of Fragrance Passion or its partners. Any reproduction, representation, modification, extraction, or exploitation, in whole or in part, without prior written authorisation, is prohibited and constitutes infringement likely to give rise to your civil and criminal liability.

Third-party trademarks and product names (in particular perfume brands) referred to on the Site remain the property of their respective owners and are mentioned solely for the purpose of identifying the products offered for sale.

Article 5 - Customer reviews and content

If the Site allows reviews, comments, or other content to be posted, you agree that such content shall be accurate, lawful, and free from insulting, defamatory, misleading statements or any infringement of third-party rights. You grant us a free, non-exclusive right to use, reproduce, and display such content in connection with the operation of the Site. We reserve the right to remove any content that is contrary to these GTU or to the law, without prior notice.

Article 6 - Liability

The Site and its content are provided "as is". We make every effort to ensure the accuracy of the information published (descriptions, visuals, availability), but cannot guarantee that it is free from errors. Product photographs and descriptions have no absolute contractual value and shall not incur our liability beyond what is provided for under the statutory guarantees detailed in the General Terms and Conditions of Sale.

We shall not be held liable for indirect damage resulting from the use of the Site, nor for malfunctions related to the internet network, the user's equipment, or an event of force majeure.

Article 7 - Links to third-party websites

The Site may contain links to third-party websites that we do not control. We disclaim all liability regarding their content, practices, or privacy policies. Access to such third-party websites is at your sole responsibility.

Article 8 - Personal data

The processing of your personal data in connection with the use of the Site is described in our Privacy Policy, which we invite you to consult.

Article 9 - Amendment of the GTU

We reserve the right to amend these GTU at any time. The applicable version is the one in force on the date of your use of the Site. We invite you to consult them regularly.

Article 10 - Applicable law and disputes

These GTU are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have jurisdiction under the conditions provided for by law. In accordance with the Consumer Code, the consumer may refer the matter free of charge to a consumer mediator with a view to the amicable resolution of a dispute; the contact details of this mediator are set out in our General Terms and Conditions of Sale and our legal notice.
